The rules of release for coasting trade realization of vessels with flags of the foreign state

The document includes:

—  The decree № 1113 of the President of the Republic of Kazakhstan on 9 November 2005

—  The regulation of the rules is applied to all the vessels with flags of the foreign state, transporting and tugging in communication between sea ports of RK, also from loading ports (terminals) to discharge one, being in jurisdiction of RK.

—  Permission for coasting trade realization by foreign vessels is issued by the general executive authority, implementing state policy, state control and supervision, coordination and activity regulation in merchant shipping field within the limits of competency.

The rules of use of undersized vessels and their mooring bases (structures)

The document includes:

—  The decree № 798 of the President of the Republic of Kazakhstan on 14 July 2011

—  Determine the order of use of undersized vessels and their mooring bases in sea coastal waters, internal water ways and other basins of RK.

—  Control of the implementation of the Rules is regulated by territorial authorities of the Committee of transport control of Ministry of Transport and Communications of RK.

—  Individuals, violating the Rules, bear responsibility in accordance with the current legislation of the Republic of Kazakhstan.

The use of foreign sea vessels in Kazakhstan

Currently Kazakhstan sector of the Caspian basin is considered to be the most perspective place of hydrocarbons production. However, there are some commonly encountered problems and the region development depends on them significantly. One of the difficulties for normal functioning of Caspian oil producing companies is the fact the legislation of RK currently remains at the stage of formation in the shipping field.

On the other hand, a vitable sea fleet is absent as before in the Republic, whereas neighboring Caspian states own their sea fleets. Kazakhstan undertakers are obliged to freight foreign vessels in the course of their activity. The fact together with insufficiently developed legislature in merchant shipping field is the reason of different problems, salvation of which causes strict difficulties and unjustified material and temporary costs at times.
